JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-04-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Kalyanpur P.S. Case No. 03 of 2017 registered for the offences punishable under Sections 414/34 of the Indian Penal Code. Allegedly, acting on a tip off that the petitioner was in possession of stolen Passion Pro Motorcycle, raid was conducted and then the petitioner was caught with that motorcycle and he did not produce any paper. The petitioner disclosed that he has purchased the said motorcycle from Anikat Kumar Rai and Ram Prasad Rai for Rs. 7,000/-.

Submission is of false implication and that nothing was recovered from possession of the petitioner, he has been made victim of circumstances, he is suffering in custody since 03.01.2017 and as such he deserves sympathetic consideration.

Patna High Court Cr.Misc. No.15651 of 2017 (2) dt.20-04-2017 Learned APP opposes the prayer of bail.

In the facts and circumstances stated above, at present, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected.

However, the petitioner is at liberty to renew his prayer of bail after remaining six months in custody.
