Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 354, 379, 447, 504, 506/34 of the Indian Penal Code.
The prosecution case is that on protest being made for ploughing the land, the accused persons assaulted the informant and made attempt to ravish the daughter and wife of the informant when they came to save the informant. It is submitted by the learned counsel for the petitioner that no such injury has been caused to the informant. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above
Patna High Court Cr.Misc. No.3769 of 2016 (2) dt.25-01-2016 named petitioner be released on provisional anticipatory bail for three months in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Dandkhora P.S. Case No. 67 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
The learned court below will confirm the provisional bail of the petitioner, if it is found that the informant has not received any grievous injury, otherwise petitioner will surrender and pray for regular bail. (Dinesh Kumar Singh, J) P.K./- U T
