This is a petition for grant of anticipatory bail for offence under Sections 328, 363, 354 and 34 of the Indian Penal Code.

The petitioners and others allegedly kidnapped to the informant by putting some intoxicating thing at her nose. However, the police came and victim was rescued and one of the criminal associates was apprehended. The reason for occurrence is land dispute. The victim has supported the allegation in her statement under Section 164 of the Criminal Procedure Code.

I do not any merit in the submission of the petitioner that petitioners' side had lodged a criminal case

Patna High Court Cr.Misc. No.13273 of 2017 (3) dt.10-05-2017 2/2 against the informant of this case that's why the present case has been lodged because the case of the petitioner is subsequent to the present case.

Considering the nature of allegation, in my view this is not a fit case for anticipatory bail. The prayer for anticipatory bail is refused.

However, prayer for regular bail shall be considered without being prejudiced of this order. (Birendra Kumar, J) SA/- U √ T √
