2. The present Cr. Misc. Application has been filed under Section 482 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "BNSS, 2023") for grant of anticipatory bail to the petitioner who apprehends his arrest in connection with Pali P.S. Case No. 55 of 2024 lodged on 08.07.2024, for the offence punishable under Sections 126(2), 115(2), 352, 351(2), 351(3), 109, 303(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as "BNS, 2023").
3. As per the prosecution, FIR has been lodged against two named accused persons including the present petitioner against whom there is allegation that they have assaulted the informant's son by iron rod and danda due to which he sustained

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that petitioner is a student aged about 19 years. Counsel submits that criminal antecedent of the petitioner is not clean as there is case pending against him in which he is on bail. Counsel further submits that from the FIR, it become crystal clear that the informant's son and other 4-5 persons have entered in the petitioner's mango orchard due to which, the whole dispute took place and resulted into head injury.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that there is head injury caused to the informant's son which is dangerous to life and petitioner's criminal antecedent is also not clean.
6. It transpires to this Court that the dispute has arisen due to disturbance made in the petitioner's mango orchard. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Judicial
