JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 26-04-2017 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner wants to renew his prayer for bail, which was earlier rejected vide order dated 10.03.2016 passed in Cr. Misc. No. 51281 of 2015, on the ground that the petitioner is suffering in custody since 16.04.2015. During investigation witness Sitapari Devi has stated that the petitioner and co-accused opened indiscriminate firing and the co-accused has been allowed bail and as such, the petitioner also deserves sympathetic consideration. Further, in the post mortem report only one fire arm injury has been found though there is allegation that the petitioner and co-accused Umesh Yadav and Surendra Yadav fired causing his death.

Patna High Court Cr.Misc. No.14447 of 2017 (3) dt.26-04-2017 2/2 The learned A.P.P. submits that the petitioner has got criminal antecedent.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected. However, let the trial be expedited and concluded as early as possible, preferably within six months from the date of receipt/production of a copy of this order.
