Although, a counter affidavit has been filed on behalf of the State, however, in the given facts and circumstances of the case, learned counsel for the State agrees that the matter may be considered by the District Magistrate, Katihar (Respondent No. 2) keeping in mind the relevant guidelines and the rules framed for grant of license of the Fair Price Shops. In the aforesaid view of the matter and without going into the merit of the contentions of the parties, this Court directs the District Magistrate, Katihar (Respondent No. 2) to look into
