JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

On getting confidential information regarding assemblage of anti-social elements for the purpose of commission of dacoity, a raid was conducted and during course thereof, miscreants began to flee, who were chased out of whom, one was apprehended, who happens to be none other than the petitioner. It is also evident that from his possession, one countrymade loaded pistol, three live cartridges along with other items were seized. Petitioner happens to be under custody since 24.09.2014. From Para-3 of the petition, it is evident that petitioner has specifically disclosed that he has got no criminal antecedent. However, from the order impugned, it is evident that

Patna High Court Cr.Misc. No.58453 of 2015 (02) dt.05-02-2016 learned Additional Public Prosecutor has submitted that several cases are pending against the petitioner.

In the aforesaid background, the learned lower Court will trace out whether there happens to be criminal antecedent of the petitioner or not and in case of absence of criminal antecedent, petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Dariyapur P. S. Case no.212 of 2014.
