07.09.2020 Heard, Mr. Dewendra Narayan Singh, learned counsel for the petitioner and Ms. Pronoti Singh, learned counsel for the State. The petitioner seeks bail in anticipation of his arrest in connection with Saran (Chapra) Town P.S. Case No. 748 of 2019 dated 17.12.2019 instituted for the offences under Sections 30(a), 41(i)(ii) of the Bihar Prohibition and Excise Act.

Regard being had to the nature of accusation in the First Information Report, I am not inclined to grant anticipatory bail to the petitioner.

The prayer is rejected.

However, if the petitioner surrenders before the court below and seeks bail, it shall be considered on its own merit without being prejudiced by the fact that the present petition has not been entertained.

This application stands dismissed with aforesaid observation. (Ashutosh Kumar, J) Sunil/- U T
