This application for regular bail arises out of Gaighat P.S. Case No. 299 of 2019, disclosing offence punishable under Section 394 of the Indian Penal Code.
Allegedly, three unknown miscreants robbed the informant of cash of Rs. 20,000=00. Before snatching the said amount, they had allegedly shot a fire, which had hit the informant's mobile phone, which he was carrying in his pocket. The petitioner's name has surfaced on the basis of confessional statement of one Santosh Kumar Sahni.
Learned counsel appearing on behalf of the petitioner has submitted that co-accused Vinay Kumar, whose name has also surfaced on the basis of said confessional statement of co-
Patna High Court CR. MISC. No.9342 of 2020(3) dt.02-06-2020 2/2 accused Santosh Kumar Sahni, has been allowed regular bail by this Court by order dated 28.02.2020, passed in Cr. Misc. No. 11509 of 2020. He contends that except for confessional statement of the co-accused, there is no incriminating material collected during the course of investigation to connect the petitioner with the alleged offence.
Considering the facts and circumstances noted above, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Sub-Judge-XVIth cum ACJM-XVth, Muzaffarpur in Gaighat P.S.
