The petitioner seeks bail in connection with Araria P.S. Case No.921 of 2023 from the Court of learned Sessions-cum-Special Judge NDPS Act, Araria registered for the offence under Sections 8, 20(b), (ii) and (C) of the NDPS Act.

3. As per the prosecution case, it is a case of recovery of some ganja from a truck. 4.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case. Petitioner is in custody since 03.10.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner.

On perusal of the first information report and the impugned order, it appears that total 602 kg. ganja was recovered from a truck bearing registration no.RJ-02-GA-8279, the ganja was recovered from a secret chamber of the truck after thoroughly checking it and the arrested person disclosed that unknown person gave the truck to drive it to Hajipur and he had no knowledge about the said ganja. It also appears that the ganja was recovered from the conscious possession of the petitioner and the petitioner is the driver of the said truck and the truck was recovered after nine days of the alleged occurrence and total amount of ganja recovered is 602 kg. which is thirty times more than the commercial quantity-20 kg, considering the quantity of ganja recovered, I am not inclined to grant bail to the petitioner.
