12-04-2017 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. Petitioner is languishing in judicial custody since 17.02.2017, in connection with Jamui P.S. Case No. 39 of 2017, registered for the offence punishable under Sections 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case, as lodged by the informant, is that one Chandan Singh took away her son, Md. Khurshid and his friend Md. Raja to Manniadda Chowk and after 1/2 hour she received information that her son and his friend both have been killed. She later got information that Rocky Singh and Anshu Singh have murdered her son on a contract given by Md. Shamshad Alam.
Patna High Court Cr.Misc. No.15617 of 2017 (2) dt.12-04-2017 It has been submitted by learned counsel for the petitioner that petitioner is innocent and not named in the First Information Report and also he has no criminal history. The only allegation as has surfaced during investigation that petitioner took the accused in his car. Hence, no under either of the Sections of the Indian Penal Code or Arms Act is made out against him.
However, learned Additional Public Prosecutor opposes the prayer for bail.
Considering the facts and circumstances and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No. 39 of 2017, subject to the condition that the petitioner will appear before the police/court as and when required, failing which his bail bond is entitled to be cancelled. (Nilu Agrawal, J.)
