The petitioner seeks bail in Ekangar Sarai P.S. Case No. 17 of 2017, registered for the offences punishable under Section 392 of the Indian Penal Code.

The informant alleged that while he was going to Sasural three persons came and accosted him of his motorcycle and Rs. 1500/- from his pocket.

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot and nothing has been recovered from possession of the petitioner. From perusal of the paragraph-41 of the case diary, it appears that the informant is said to have identified the petitioner after seeing the photographs of petitioner in premises of the police station, but the petitioner has

Patna High Court Cr.Misc. No.11894 of 2017 (3) dt.10-04-2017 2/2 not been put on test identification parade. The petitioner is in jail since 11.02.2017. The petitioner has already remained in jail for about two months but he has not been put on test identification parade.

Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Hilsa, Nalanda in Ekangar Sarai P.S.
