The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and sections 25(1-B)(a) and 26(ii) of the Arms Act.

As per the prosecution case, the petitioner herein who is an accused in another case on being surrounded by the police made an attempt to escape and also fired upon the police personnel. The shot misfired. On being caught, a live cartridge besides other articles was recovered from his possession. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his

Patna High Court CR. MISC. No.22229 of 2021(2) dt.08-10-2021 2/2 possession. The police personnel have fabricated the case against him. He is in custody since 9.8.2020 and chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Laukahi P.S. Case no.140 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jhanjharpur, District Madhubani.
