JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Laxmipur (Gidhour) P.S. Case No. 188 of 2016, registered under Sections 386 and 366(A) of the Indian Penal Code.

The accusation is of enticing away the daughter of informant by this petitioner.

Learned counsel for the petitioner submits that, in fact, daughter of the informant moved from house and performed the marriage with this petitioner according to her own sweet will, this fact has been stated by the daughter of informant in her statement as recorded, under Section 164 Cr.P.C. and she also disclosed her age 18 years. In the medical examination, her age is assessed as 17

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Jamui, in connection with Laxmipur (Gidhour) P.S. Case No. 188 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
