The petitioner apprehends his arrest in Dehri (Indrapuri) Police Station Case No 648 of 2016 instituted for the offence under Sections 341, 323, 504, 325, 307/34 of Indian Penal Code.
There is allegation against the petitioner that he has assaulted the brother of the informant Dhirendra Kumar Dubey with iron rod on his head. The injury report has been annexed as Annexure 4 which shows one lacerated wound on right side of the forehead measuring 1.5x1/4 bone deep. CT scan of the brain was advised and opinion with regard to type of injury was reserved. No final report has been received. From the injury report, it appears that there is no repetition of blows made by the petitioner.
Patna High Court Cr.Misc. No.16031 of 2017 (2) dt.05-05-2017 2/2 It is apparent from the written report that there is land dispute. Other co-accused persons have already been granted anticipatory bail by this Court in Cr Misc No 10710 of 2017. In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed.
In the event of surrender/arrest of the petitioner named above within six weeks from today in connection with Dehri (Indrapuri) Police Station Case No 648 of 2016, he shall be released on anticipatory bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Dehri, Rohtas subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code with further conditions (1) bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned, (2) petitioner shall cooperate in the trial and shall be present on each and every date fixed by the Court and absence on two consecutive dates without proper and reasonable reason will automatically cancel bail bond of the petitioner and (3) if petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
