The petitioner, who is in custody, seeks bail in connection with Sikta P.S. case No. 49 of 2016 instituted under Sections 272 and 273 of the Indian Penal Code and Section 47(a) of the Bihar Excise Amendment Act, 2016.

The allegation, in brief, is that one co-accused Muskan Kumar was apprehended and from his possession 55.05 litres of nepali liquor was recovered and he disclosed name of the petitioner alleging his involvement also.

Learned counsel for the petitioner submits that there is no material against the petitioner except his name disclosed by the said co-accused, and the petitioner has also got no criminal

Considering the aforementioned facts and circumstances, the petitioner, named above is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IIIrd, Bettiah in connection with Sikta P.S. case No. 49 of 2016.
