2. The petitioner seeks bail in Gogari P.S. case No. 221 of 2023, G.R. No. 2019/2023 instituted for the offences under Sections 341, 323, 498(A), 504, 506 of the Indian Penal Code and Section 3 and 4 of Dowry Act.

3. Prosecution allegation, in short, is that the petitioner assaulted the informant on account of non-fulfilment of demand of dowry.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is the husband of the victim and

Patna High Court CR. MISC. No.14004 of 2024(2) dt.07-03-2024 2/2 and in fact the victim is living with the petitioner. Owing to some family feud, the present false case has been lodged against the petitioner. The petitioner is in custody since 21.06.2023 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, clean antecedent and the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Gogari P.S. case No. 221 of 2023, G.R. No. 2019/2023.
