Petitioner is named in the first informant report with allegation that he sexually abused the informant but submission on behalf of the petitioner is that Section-376(C) of the Indian Penal Code is not applicable and so far as Section-354A of the Indian Penal Code is concerned; the petitioner is in jail custody since 0510-2015 and as a matter of fact, the present case has been lodged by the informant on account of salary dispute. It is further contended by him that moreover, the concerned school is being run by wife of the petitioner and the petitioner is a government teacher.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner named

Patna High Court Cr.Misc. No.48 of 2016 (2) dt.05-01-2016 2/2 above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Phulwarisharif P.S.
