JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The statement of victim has been recorded under section 164 of the Cr.P.C in which she stated that it was coaccused Ashraf Ansari, who committed rape on her. Although victim stated that petitioner and others kidnapped her but submission on behalf of the petitioner is that the victim was pressurizing co-accused Ashraf Ansari to solemnize marriage with her and as a matter of fact, victim solemnized her marriage with Ashraf Ansari but admittedly some dispute had arisen between them and the victim lodged this present case. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.225 of 2016 (2) dt.05-01-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S.Case No. 197 of 2013.
