Petitioner seeks bail in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The petitioner is the father-in-law of the deceased. Marriage of the victim-lady was solemnized eight years prior to her death with Md. Irshad, the son of this petitioner. Md. Irshad is not an accused in this case. There is general and omnibus allegation of commission of death for dowry.

Submission is that presumption of dowry death is not there against the petitioner and co-accused, namely, Zeenat Parween has been allowed bail by a Co-ordinate Bench of this Court vide order dated 28.02.2017 passed in Cr. Misc. No. 9227 of

Patna High Court Cr.Misc. No.10299 of 2017 (2) dt.18-03-2017 2/2 2017.

Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur/successor Court in connection with Karja Police Station Case No. 33 of 2016.
