Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code.

The prosecution case is that the accused persons demanded extortion of rupees ten lakh through letter and mobile phone from the brother of the informant. It is submitted by the learned counsel for the petitioner that the mobile phone referred in the First Information Report belongs to Raj Kumar and they are not of the petitioner. Statement to that effect has been made in paras8 and 10 of the petition. Though the petitioner is accused in one other case of the similar nature.

Patna High Court Cr.Misc. No.4414 of 2016 (2) dt.01-02-2016 In the circumstances, it is a case for consideration of prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Rajepur P.S. Case No. 131 of 2014, pending in the court of learned Sub-Divisional Judicial Magistrate, Motihari, East Champaran.

With the above observation this application is disposed of.
