JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-02-2019 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Jakkanpur P.S. Case No. 645/2018 (Special Case No. 12287/2018), for the offence under Section 273/34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioner submits that in the instant case 72.9 litres of liquour was seized. Nothing was recovered from the conscious possession of the petitioner. The petitioner has clean antecedent.

The Petitioner is in custody since 02.01.2019. Considering the fact that the petitioner has no criminal antecedent, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Ten thousand) with two sureties of the
