JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-07-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard the learned counsel for the petitioners and the learned APP for the State.
The present petition has been filed for modification of the order dated 02.07.2020, passed in Cr. Misc. no. 14574 of 2020 to the extent that the time granted to the petitioners for surrendering before the learned court below be further extended
Patna High Court CR. MISC. No.16244 of 2021(2) dt.14-07-2021 2/2 by a period of four weeks from today.
The learned counsel for the petitioners submit that on account of the prevailing situation due to Covid-19 Pandemic, the petitioners could not surrender within the stipulated time, inasmuch they were not present in the State of Bihar and had gone outside the State for their livelihood.
The learned APP for the State Sri Kalyan Shankar does not oppose the extension of time to be granted to the petitioners to surrender before the learned court below. Having regard to the facts and circumstances of the case, considering the averments made in the present petition, I deem it fit and proper to grant four weeks' further time to the petitioners to surrender before the learned court of Judicial Magistrate 1st class, Gopalganj in connection with Manjhagarh PS case no. 282 of 2018 in order to avail the privilege of anticipatory bail.
Accordingly, the present petition stands allowed with the aforesaid modification in the order dated 02.07.2020, passed in Cr. Misc. no. 14574 of 2020.
