2. The petitioner is in custody in connection with S.T. No. 654 of 2023 arising out of Amarpur P.S Case No. 469 of 2023 from the Court of learned A.D.J. III, Banka registered for the offences punishable under Sections 302 of the I.P.C.

3. As per allegation in the FIR, petitioner has assaulted informant's husband by means of axe, as a result, informant's husband got injured and during the course of treatment he died.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.12899 of 2024(2) dt.28-02-2024 2/2 petitioner has falsely been implicated in this case. Petitioner is not arrested on the spot. It is also submitted that petitioner is in judicial custody since 17.07.2023 and petitioner has got no criminal antecedent as stated in para 3 of the petition.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner and submitted that death of deceased is by means of repeated blow of axe on head.

6. In view of the direct allegation against the petitioner and considering the postmortem report, injury of the victim this Court is not inclined to grant bail to the petitioner.

7. Hence, the prayer for regular bail of the petitioner is rejected.
