Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners apprehend their arrest in Parbatta P.S. Case No. 65 of 2018, registered for the offences punishable under Sections 341, 323, 308, 506 and 34 of the Indian Penal Code.
Prosecution case in brief is that while the informant was constructing his house, the petitioners having armed with lathi, Danda and weapons came there and started assaulting him
Patna High Court CR. MISC. No.11047 of 2020(2) dt.16-06-2020 2/2 and his wife, as a result of which they became seriously injured. It is submitted that petitioners have falsely been implicated in this case. Both parties are Gotiyas. Admittedly, there is land dispute between the parties. There is case and counter. The petitioners have got clean antecedent. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IIIrd, Naugachiya, Bhagalpur in connection with Parbatta P.S. Case No. 65 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
