JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have been caught by the informant in his house when petitioner had entered in his house to commit theft. Subsequently, petitioner was handed over to police on 15.9.2015 whereas the alleged occurrence is said to have taken place in the night of 12.9.2015. Learned counsel for the petitioner submits that as a matter of fact, petitioner has inimical terms with the informant and much prior to institution of the present case, the informant of this case had lodged Mahua P.S. Case No.176 of 2007 against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named

Patna High Court Cr.Misc. No.159 of 2016 (2) dt.05-01-2016 2/2 be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S.
