====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-04-2024 Heard learned counsel for the petitioner and Mr. Pramod Kumar Pandey, learned A.P.P. the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.
3. As per the F.I.R., this petitioner along with other accused persons misbehaved with the daughter of the informant. It is also alleged that the accused persons brutally assaulted the son of the informant and made indiscriminate firing.
4. It is submitted on behalf of the petitioner that he has falsely been implicated in this case. Allegation against the petitioner is general and omnibus and there is no specific allegation of overt act against him. It is next submitted that due to earlier dispute between the parties, this petitioner has been made accused only with a view to harass him. Admittedly,
Patna High Court CR. MISC. No.14174 of 2024(3) dt.29-04-2024 2/2 informant is not an eye witness of the occurrence and petitioner has been made accused only on suspicion. Lastly, it is submitted that though there is allegation of firing but no one sustained any fire arms injury. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar Mufassil P. S. Case No. 460 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
