JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-01-2016 This application has been filed on behalf of the petitioner for modification in the order dated 08.10.2015 passed in Criminal Misc. No. 42551 of 2015 by this Court with regard to extend the period of surrender of the petitioner in the Court below. Learned counsel for the petitioner submits that by the order dated 08.10.2015 passed in Criminal Misc. No. 42551 of 2015, in the event of his arrest or surrender before the learned court below by the petitioner Kamal Sah within a period of four weeks from that day, the petitioner was granted anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Kanti P.S. Case No. 236 of 2015, subject to the conditions laid down

Patna High Court Cr.Misc. No.4171 of 2016 (2) dt.27-01-2016 2/2 under Section 438 (2) Cr.P.C. but the petitioner could not surrender within a period of four weeks as granted by the said order. In that view of the matter, learned counsel for the petitioner prays for extension of period of surrender of the petitioner in the Court below.

Considering the submission of the learned counsel for the petitioner, the period of surrender of the petitioner in connection with the aforesaid case in the Court below is further extended for four weeks from today and this application is, accordingly, allowed with the aforesaid modification in the order dated 08.10.2015 passed in Criminal Misc.
