The petitioner seeks bail in connection with a case registered the offences punishable under Sections 394 of the Indian Penal Code.

Diary in this case was called for earlier which has since been received.

Learned counsel for the petitioner submits that the petitioner has been in custody since 24.08.2015 and though he is named in the First Information Report, there has been no recovery from his conscious possession. It is further submitted that the petitioner has been falsely implicated and the person who made the confessional statement has been extended the privilege of bail by the Court below.

No.119 of 2016 (3) dt.05-02-2016 P2/2 Considering the aforementioned facts and circumstances of the case and the period custody, let the petitioner Shambhu Sahni be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 224 of 2014.
