The petitioner is accused in connection with Khanpur P.S. Case No. 94 of 2016, registered under Sections 457, 380 and 411 of the Indian Penal Code.

The accusation is that when informant Naresh Sah, reached at his grocery shop then found that back door of his grocery shop was broken and one person found in the shop. On raising alarm, villagers came there and that person was apprehended, who disclosed his name as Ranjit Kumar Sharma (petitioner). It was detected that cash of Rs.17,500/- and articles worth of Rs.4,000/- was missing. On query, Ranjit Kumar Sharma (petitioner) also disclosed the name of his associate Anil Kumar

Patna High Court Cr.Misc. No.20112 of 2017 (2) dt.11-05-2017 Mahto. Thereafter, Anil Kumar Mahto was apprehended, who disclosed that he handed over the money to his mother and theft articles are kept in orchard.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner and the informant are co-villagers and in the early morning, petitioner was going to attend the call of nature then he was apprehended by the informant with the help of villagers mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 13.09.2016. The charge sheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Samastipur, in connection with Khanpur P.S. Case No. 94 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
