This is the second attempt on behalf of the petitioner for grant of bail in connection with Sohsarai P.S. Case No.23 of 2022 registered for the offence under sections 302, 328 and 120-B of the Indian Penal Code and under sections 33, 34 and 36 of the Excise Act. Earlier, the prayer of the petitioner for grant of bail has been rejected by this Court vide order dated 05.10.2024 passed in Criminal Miscellaneous No.67016 of 2024.

The petitioner is involved in the death of eight persons who had consumed illicit liquor. 4.

It has been submitted by learned counsel for the petitioner that all the co-accused persons, except the present petitioner, have been granted bail. The petitioner is in custody

Patna High Court CR. MISC. No.12140 of 2025(2) dt.02-05-2025 2/2 since 14.09.2023.

Considering the period of custody of the petitioner and also the fact that other co-accused persons have been granted bail, this bail application is allowed. 6.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise-II, Nalanda at Biharsharif / concerned Court below, in connection with Sohsarai P.S. Case No.23 of 2022, subject to the condition that both the bailors will be the blood relatives of the petitioner.

This is also subject to the condition that the petitioner shall cooperate in the trial and will appear himself or through his lawyer on each and every dates fixed in the trial. Further, the petitioner shall mark her attendance at Sohsarai Police Station, District- Nalanda on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
