The petition is filed for extension of period for repaying the loan to the opposite party no. 2. The petitioner was granted anticipatory bail vide order dated 02.09.2015 passed in Cr. Misc. No. 11821 of 2015. As per the terms of compromise the petitioner had to pay first installment of Rs. 1,50,000/- to the opposite party no. 2 on 30.11.2015, Rs. 1,50,000/- on 31.01.2016 and 3rd and 4th installment of Rs. 1,00,000/- each on 15.04.2016 and 15.06.2016 respectively.
Learned counsel for the petitioner submits that Rs. 2,50,000/- has already been paid to the opposite party no. 2 and he will deposit rest of the amount by December, 2015. Learned counsel for the opposite party no. 2 did not
Patna High Court Cr.Misc. No.11851 of 2016 (4) dt.17-10-2016 2/2 object.
Considering the facts aforesaid, the petitioner is allowed to deposit rest of the amount by 15.12.2016 and if the petitioner fails to deposit the remaining amount by 15.12.2016, the court below shall cancel the bail bond of the petitioner immediately thereafter.
With this observation, the modification petition is disposed of.
