JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being father of the husband of the victim is languishing in custody since 1.10.2015 in a case initially registered for the offences punishable under Sections 498A and 306/34 of the Indian Penal Code. Subsequently, section 302 IPC was added.
The prosecution case is that the informant got his daughter Saraswati Devi married with the petitioner in 2000. On 8.3.2015 the husband assaulted the daughter of the informant as a retaliatory measure the victim poured kerosene oil and lit the fire. Patna High Court Cr.Misc. No.500 of 2016 (2) dt.05-01-2016 2/2 has been granted bail vide Cr. Misc. No. 42179 of 2015. More over, on conclusion of investigation, the final form (chargesheet) has been submitted under sections 498A and 306/34 IPC. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bhojpur at Ara in connection with Piro Nagar P.S. Case No. 79 of 2015.
