====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-04-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 354, 354(B), 506, 509 of the Indian Penal Code and Section 67 of the Information Technology Act.

As per prosecution case, petitioner and informant are next door neighbours. It is alleged that petitioner took objectionable photographs of daughter of the informant while she was taking bath and threatened to viral them. Later on, after two days, those photographs were made viral from the Facebook account of co-accused Lalu Kumar, who is friend of the petitioner.

Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.10774 of 2023(2) dt.28-04-2023 2/2 that alleged photographs were made viral from the Facebook account of co-accused Lalu Kumar. Petitioner has been made accused only because he is friend of co-accused Lalu Kumar. Petitioner claims clean antecedent.

Considering the aforesaid facts of the case, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bhagalpur in connection with Kajrailli P. S. Case No. 66 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
