2. The present petition has been preferred for the
Patna High Court CWJC No.2496 of 2016(2) dt.15-07-2025 2/3 following relief(s):
"(i) For payment of compensation amount to the petitioners for their lands acquired under Bagmati Project in the Village-Dhanaur, Chadar No. 3 for construction of Ring Bandh in the year 2010-11.
(ii) For direction to the authorities to decide the categories of acquired land for payment of compensation to the land holders.
(iii) For direction to the authorities to make payment to the land lord through Account payee cheque in the Village after holding a camp. iv) For direction to the authorities to pay the compensation amount with compound interest at statutory rate.
(v) Any other relief/reliefs may be granted to these petitioners under the facts and circumstances of this case."
3. A counter-affidavit has come on behalf of the respondent no. 13 and paragraph-7 shows that the land of the petitioners never came to be acquired nor the possession was handed over to Executive Engineer. In that background, no
Patna High Court CWJC No.2496 of 2016(2) dt.15-07-2025 3/3 construction was made and thus, question of declaring the award/making payment of compensation does not arise.
4. This counter-affidavit was filed in the year 2016. The reply to the counter-affidavit however makes a denial without any relevant document.
5. In that background, granting liberty to the petitioner that contrary to the specific statement made by the Staterespondent that no construction has been made, the story is otherwise, will have the right to approach the District Collector with appropriate petition.
6. The writ petition as also the Interlocutory Application stands disposed of with aforesaid observation. (Rajiv Roy, J) Adnan/- U
