JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2017 The petitioner is in custody since 31.07.2016 in connection with Silao P.S. Case No. 196 of 2015, registered for offences punishable under Sections 304B/34 Indian Penal Code. It has been submitted on behalf of the petitioner that case is under Section 304B and petitioner is husband, however, the informant in his restatement has himself admitted this fact that mental condition of the deceased was not good. This fact also found substantiated with the statement of witnesses during the course of investigation in para 28 and other paragraphs of the case diary and the petitioner was not present at the time of alleged occurrence as he was in Delhi with his brothers in connection with
Patna High Court Cr.Misc. No.15243 of 2017 (4) dt.12-04-2017 2/3 earning his livelihood. Petitioner has been in judicial custody since 31.07.2016, without any fault on his part.

Having heard both sides, considering the facts and circumstances of the case, period of custody and also several paragraphs of the case diary supports the submission of learned counsel for the petitioner, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Silao P.S. Case No. 196 of 2015, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the
Patna High Court Cr.Misc. No.15243 of 2017 (4) dt.12-04-2017 3/3 court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
