JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 398 of the Indian Penal Code and 25(1-B)a/26/35 of the Arms Act.
Two cartridges were allegedly recovered from the possession of the petitioner.
Submission is that petitioner has stated on oath that he has got no criminal antecedent.
Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief
Patna High Court Cr.Misc. No.9141 of 2017 (3) dt.29-03-2017 2/2 Judicial Magistrate-IX, Bhojpur at Ara/Successor Court, in connection with Jagdishpur P.S. Case No.304 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
