JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 This application, for grant of anticipatory bail, arises out of Special Case No. 3745 of 2018, arising out of Bihta P.S. Case No. 395/2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act.
Allegation is of recovery of 400 litres of Mahua liquor from the bank of Sone Rive and it is alleged that the petitioner and others were preparing the illicit liquor and on seeing the police, they fled away.
Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case and nothing has been recovered either from the conscious possession of the petitioner or from his house.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 3745 of 2018, arising out of Bihta P.S. Case No. 395/2018, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
