The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 384 & 504 of the Indian Penal Code andn Section 25 (1-b) of the Arms Act.

On the information given by one Santosh Kumar that Vicky Yadav (petitioner) without paying money takes article and cigarette from his shop on the threat and when the informant reached near the shop of Santosh Kumar, on seeing the police party the petitioner after throwing his pistol fled away.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.9169 of 2020(2) dt.28-02-2020 2/2 petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case by the police at the instance of Santosh Kumar due to previous enmity. No incriminating article has been recovered from his conscious physical possession. He has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Pakribrawan P.S. Case No.385 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
