JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-01-2022 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 56 of 2020 registered under Sections 376, 313, 341, 323, 504 and 506/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to some ulterior motive. Further submission is that the instant first information report has been lodged after a delay of 21 days without any explanation. On perusal of Annexure-2 (Medical Report), the informant was medically examined but neither any sign of abortion nor any sign of sexual assault has been found. Petitioner has no criminal

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the S.D.J.M., Araria in connection with Mahila P.S.
