JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with C.B. No. 70/16 registered under Sections 30(Ka) and 47 of the Bihar Prohibition and Excise Act,2016.

The accusation is that on receiving secret information Excise officials reached at the godown of M/s Sri Durga Puls Industry, Industrial Area, Fatuha and seized 9667.08 litres of foreign liquor kept in a container bearing Registration No.HR 55 x-9389 from where eight persons were apprehended. Learned counsel for the petitioner submits that coaccused Raj Kumar Sharma and this petitioner disclosed that they

Patna High Court Cr.Misc. No.13534 of 2017 (2) dt.06-04-2017 2/2 were driver and Assistant driver respectively and both were deputed to drive the vehicle from U.P. to Fatuha. Further submission is that the petitioner has got no criminal antecedent who is in jail custody since 23.10.2016.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000 with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.,Patna City, Patna, in connection with C.B.Case No.70/16.
