The petitioner seeks regular bail in connection with Special Case No.11037 of 2019 (arising out of Nadi P.S.Case No.302 of 2019) registered for offences punishable under Section 30(a) of Bihar Prohibition Excise Amendment Act. There is recovery of 154.8 ltrs. of liquor from the heap of the straw kept behind the open place of the school and the petitioner and two other accused persons are named in the FIR.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case. He is in custody for more than 2 1⁄2 months. He is accused in one more case but he is on bail in that case. There is no chance of tampering with the evidence.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise) Act, Patna in connection with Special Case No.11037 of 2019 (arising out of Nadi P.S.case No.302 of 2019). Accordingly, this application is allowed.
