The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 353 and other allied sections of the Indian Penal Code. As per the prosecution case, on 17.04.2019, on receiving an information that a quarrel took place between the two groups, the informant along with other police officials went there and tried to pacify the matter, but the accused persons started pelting stones, bricks, in which, informant sustained injury on his head, lips and one of his tooth got uprooted. It is submitted that there is general and omnibus allegation against all the accused persons and no specific overt act has been alleged against petitioner. Petitioner is only member of mob and he claims clean antecedent.

No.18001 of 2023(2) dt.24-06-2023 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Patna in connection with Digha P.S. Case No. 224 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
