JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Laxmipur (Gidhour) P.S. Case No. 117 of 2016, registered under Section 366(A) of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of informant by the petitioner with the help of two others to perform marriage.

Learned counsel for the petitioner submits that victim, daughter of the informant, moved from her parental house and perform the marriage with this petitioner according to her own sweet will. Further submission is that her age has been assessed as 18 year in her statement, under Section 164 Cr.P.C, on

Patna High Court Cr.Misc. No.17592 of 2017 (2) dt.03-05-2017 28.10.2016, in which, she has stated above moving from her parental house and perform the marriage with this petitioner according to her own sweet will.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Jamui, in connection with Laxmipur (Gidhour) P.S.
