JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 17-06-2020 Heard the parties through the virtual court proceeding. The petitioner apprehends his arrest in connection with Kaler P.S. Case No.09 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 506, 504, 337, 427, 353, 436, 120(B) of the Indian Penal Code. The allegation in the F.I.R. is that in protest against death of a person in police lock-up the local public are said to have vandalized the police station and caused obstruction in due discharge of public duty by police personnel. It is alleged that there were 200-300 persons involved, out of whom 11 have been named. The petitioner is one of them.
Learned counsel for the petitioner has submitted that there is nothing specific against the petitioner. He further
Patna High Court CR. MISC. No. 9567 of 2020(2) dt.17-06-2020 2/2 submits that similarly situated co-accused has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 29.07.2019 passed in Cr. Misc. No.46762 of 2019. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of S.D.J.M., Arwal in connection with Kaler P.S. Case No. 09 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
