The petitioner seeks bail in Tajpur P.S. Case No. 92 of 2016 instituted for the offence under Section 379 of the Indian Penal Code.
It is alleged that the stolen articles are said to have been recovered from the room of the petitioner on the basis of confessional statement of co-accused and taking note of the aforesaid fact earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 12.08.2016 passed in Cr. Misc. No. 31538 of 2016 but petitioner is in jail custody since 15.5.2016 and does not have criminal antecedent. Considering the aforesaid facts and circumstances, let
