Mr.Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-03-2019 Heard the learned counsel for the petitioner and the learned counsel for the State.

The petitioner seeks regular bail in connection with Araria PS case no. 835 of 2018 registered for the offence punishable under Sections 420, 467, 468, 471 of Indian Penal Code.

The case of the prosecution is that several guest teachers including the petitioner were appointed in Sri Darwari Rai Uchch Vidyalaya, Mahthawa, Block-Bhargama on the basis of fake certificates.

The learned counsel for the petitioner submits that immediately upon joining as guest teacher, it was detected that B.Ed certificate/ degree submitted by the petitioner is fake, hence the petitioner was not able to get salary for the said period and has not ever been a beneficiary. It is further submitted that

Patna High Court CR. MISC. No.13954 of 2019(2) dt.11-03-2019 2/2 the appointment of the petitioner has stood terminated. It is further submitted that though the antecedent of the petitioner is fair but he is an accused in one other case in which he has already been granted anticipatory bail.

Per contra, the learned APP for the State has vehementaly opposed the prayer for bail.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria PS case no. 835 of 2018.
