The petitioner seeks regular bail in connection with Kuchaikot P.S.Case No.08 of 2020 registered for offences punishable under Sections 30(a)/32(2)/41(1) of the Bihr Prohibition and Excise and Amendment Act, 2018. Police on petrolling saw one container parked near the road and two motorcycle riders were talking to the driver and in the light of the vehicle, petitioner was identified by the police. Submission of the learned counsel for the petitioner is that he has no criminal antecedent. He has been falsely implicated int his case, which will appear from the fact that he was called from the house and kept confined in the police station for two days and when the father of the petitioner

Patna High Court CR. MISC. No.9026 of 2020(2) dt.03-03-2020 2/2 moved before the learned Magistrate, then he has been remanded in this case. He is in custody since 11.1.2020. He has nothing to do with the truck and no liquor was recovered from his motorcycle or from him.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ II cum Special Judge, Excise, Gopalganj in connection with Kuchaikot P.S.case No.08 of 2020.

Accordingly, this application is allowed.
