The petitioner seeks bail in Raghopur P.S. Case No. 74 of 2020, registered for the offence punishable under Sections 302, 307 and other allied sections of the Indian Penal Code. As per the FIR, eight named accused persons including this petitioner on account of land dispute with the informant assaulted Arjun Rai (brother of informant) as a result of which he died during course of treatment.

It is submitted on behalf of the petitioner that on account of land dispute between the parties petitioner has falsely been implicated in this case. The allegation of assault is general and omnibus and no specific overt act has been alleged against this petitioner. There is case and counter case. Both sides sustained injury. Similarly situated co-accused Randhir Rai and

Patna High Court CR. MISC. No.11994 of 2022(2) dt.09-05-2022 2/2 Bhullu Rai have been granted bail by this Court vide order dated 24.09.2021 passed in Cr. Misc. No. 17909 of 2021. Petitioner claims clean antecedent and he is in custody since 26.11.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Hajipur at Vaishali in connection with Raghopur P.S.
