The petitioner apprehends his arrest in connection with Majhaulia P.S. Case No.491 of 2015 for the offences punishable under Section 414 of Indian Penal Code.
Mr. Sanjay Kumar learned counsel for the petitioner with reference to the F.I.R. present at Annexure-7 submits that while it is admitted by the co-accused Deepak Kumar and Guddu Kumar that they along with one Rahul Kumar and Akhilesh Yadav were involved in theft of motorcycles and resale thereof but since one of such motorcycle was found in front of the house of the petitioner that he has been roped in the case though the statement of the coaccused does not reflect that the petitioner is one amongst them. Having heard learned counsel for the parties and
Patna High Court Cr.Misc. No.5002 of 2016 (2) dt.18-03-2016 2/2 considering the nature of allegations in the backdrop of the submission advanced by learned counsel, let the petitioner namely, Awadhesh Yadav in the event of his arrest/surrender within four weeks from today, be released on bail upon furnishing bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah in connection with Majhaulia P.S. Case No.491 of 2015 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure.
